An appeal court for the District of Columbia has consolidated 11 separate challenges to Federal Energy Regulatory Commission (FERC) rulings on the formation of Regional Transmission Operators (RTOs). FERC Order 2000 is intended to allow third party grid access at single rates for large sections of the transmission system and encourages owners to hand over control of assets. One concern is that, under the terms of the order, FERC would set the return on investment for transmission owning companies. The appeal court hearings on the order are expected over the next few months.
